Tabata Amaral: clearly signaling that feelings, convictions, or mere opinions are not to be confused with conduct that violates human dignity, which the State will no longer tolerate.
Tabata Amaral: At this point, it is worth noting that the definition of misogyny proposed in Bill No. 896 of 2023 adopts terminology that is not found in the description of other crimes that also derive from the condition of being a woman, such as femicide, qualified bodily injury, and political violence against women.
Thus, in order to preserve the conceptual uniformity of criminal and criminal-procedural legislation on the subject, we propose replacing the terms 'hate' and 'aversion' provided in the bill with the expressions 'contempt' or 'discrimination on the grounds of being a woman.'
Tabata Amaral: It should also be emphasized that the topics debated by this working group reflect a legislative concern already present in this House, materialized in various proposals which, even though they present singularities regarding the normative technique adopted or the form of operationalizing legal protection, converge unequivocally toward a larger objective.
Tabata Amaral: Such initiatives constituted an important source of reflection and study, contributing to the maturing of the debate and to the construction of the proposals now presented.
